PUBLIC HEALTH AND MINISTERIAL ORDERS RESTRICTING EMPLOYEES TO WORKING AT ONLY ONE HEALTHCARE FACILITY DUE TO COVID-19

Ministerial Order 10-2020

Pursuant to the Public Health Act, the Chief Medical Officer of Health on April 10, 2020 issued Order 10-2020 restricting employees to working at only one healthcare facility.
Paragraphs 1 and 2 of Part 1 of the Order state:
Part 1- Restricting staff movement among health care facilities
- Beginning April 16, 2020, but no later than April 23, 2020, each operator of a health care facility, and each contractor operating within a health care facility, located in the Province of Alberta, must restrict the movement of staff members among health care facilities by ensuring that each staff member works in only one health care facility.
- For the purposes of Part 1 of this Order, a "health care facility'' is defined as:
(a) an auxiliary hospital under the Hospitals Act,
(b) a nursing home under the Nursing Homes Act; and
(c) a designated supportive living accommodation under the Supportive Living Accommodation Licensing Act.

Concurrent with Order 10-2020, the Minister of Labour and Immigration issued Order 22-2020 addressing terms of employment for those employees and employers impacted by Order 10-2020.

On April 24, 2020 the Minister of Labour and Immigration issued Order 2020-26 establishing (1) the selection of healthcare facilities for those employed who are restricted to working at one facility, (2) for the creation of leaves of absence by the employer for those employees who no longer provide services to that employer, (3) for those scheduling of additional hours of work for those employees who were restricted to working at one healthcare facility, and (4) the Labour Relations Board as the tribunal to resolve disputes about the interpretation and/or the application of Order 2020-26.
On May 5, 2020 Guidelines for Expedited Proceedings have been put into place.
